7. Payment and Cancellation Policy
Payment terms are specified in the separate service agreement provided to clients. Services can be terminated immediately by Unreal Growth Digital if payment is not made as agreed upon in the service agreement.
8. Modifications
Unreal Growth Digital reserves the right to revise these terms and conditions at any time as it sees fit, and by using our services, you are expected to review these terms and conditions on a regular basis.
9. Assignment
Unreal Growth Digital may transfer, sub-contract, or otherwise deal with Unreal Growth Digital’s rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.
10. Severability
If any provision of these terms and conditions is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of these terms and conditions.
11. Entire Agreement
These terms and conditions, together with Unreal Growth Digital’s Privacy Policy, constitute the entire agreement between you and Unreal Growth Digital in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.
12. Governing Law & Jurisdiction
These terms and conditions will be governed by and construed in accordance with the laws of Australia, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of Australia.
13. Online Store Management and Ownership
a. Store Management
Unreal Growth Digital specializes in the management and operation of online stores through platforms such as Shopify. When engaging our services to manage your online store, you are entrusting us with the responsibility to design, build, and launch the store in accordance with the terms agreed upon in our Service Agreement.
b. Store Ownership
Notwithstanding any other provision of this Agreement, you acknowledge and agree that any online store created, built, and launched by Unreal Growth Digital, including all associated content, graphics, code, and data, remains the property of Unreal Growth Digital until full payment for the transfer of ownership has been made by you, the client.
c. Transfer of Ownership
If you desire to own the online store built and managed by Unreal Growth Digital, a separate agreement must be made which details the conditions including but not limited to the scope of work, transfer fees, and payment terms. Only upon the complete fulfillment of these conditions, which will include the receipt by Unreal Growth Digital of all payments due under the separate agreement, will the ownership of the store be transferred to you. Until such time, Unreal Growth Digital retains all rights to the store, and you are granted a limited license to utilize the store for your business purposes under the terms of our Service Agreement.
d. Termination of Services
Should you choose to terminate our services or fail to comply with the payment terms as outlined in the separate agreement for ownership transfer, Unreal Growth Digital reserves the right to disable, suspend, or transfer the online store at its discretion. The conditions of such termination and transfer will be governed by the terms set forth in the separate agreement.
